BOWLING GREEN – Before a packed courtroom today, a Toledo man charged with fatally shooting a Perrysburg Township woman said he wanted a new attorney.

Jose Moya, Jr., 24, told Wood County Common Pleas Judge Alan Mayberry he was “not seeing eye to eye” with Omar Shaaban, his court-appointed attorney.

“He ain’t helping me in the situation I’m in because I’m not going to plead to something I didn’t do,” Moya said.

He is charged with murder and tampering with evidence in the July 22 death of Leandra Frankum, 21. Ms. Frankum, who had been described as his on-again, off-again girlfriend, was shot once in the head after she and Moya quarreled at a home in the Perrysburg Heights neighborhood.

Prosecutors said they were prepared to offer Moya a plea agreement in which the tampering with evidence charge would be dismissed as would a repeat violent offender specification that could have added up to 10 years to his sentence.

After explaining the implications of the plea agreement to Moya, Judge Mayberry agreed to appoint new defense counsel but told him the court would choose the attorney, not him.
